New Village Landscapes & Tree Services, LLC proudly stands behind the quality of our workmanship. The following warranty information explains the limited warranties that may apply to work performed by New Village. Warranty coverage varies depending on the type of work completed and the specific scope of the project.

All warranties listed below are limited warranties and apply only to qualifying work performed by New Village Landscapes & Tree Services, LLC.

 

General Limited Warranty Terms

All warranties apply only to the original client and the original project location. Warranties are non-transferable and begin on the date the work is substantially completed, unless otherwise stated in writing.

Warranty coverage applies only to defects directly caused by New Village’s workmanship. This warranty does not cover damage, failure, or deterioration caused by lack of maintenance, improper use, neglect, abuse, weather, acts of God, drainage issues, soil movement, settlement, erosion, irrigation issues, pets, pests, vandalism, client-supplied materials, third-party work, utility work, or any condition outside of New Village’s control.

All warranty claims must be submitted in writing by email to [email protected]. Phone calls, text messages, verbal conversations, or social media messages alone do not qualify as written warranty notice.

New Village must be given the opportunity to inspect the concern before any repair, replacement, removal, modification, or third-party work is performed. If another contractor, company, or individual repairs, modifies, removes, or alters the work before New Village has inspected and approved the issue, the warranty may become null and void.

New Village will determine, in its sole discretion, whether a concern is covered under this limited warranty and whether the proper remedy is repair, replacement, treatment, adjustment, or no corrective action. Warranty remedies are limited to the covered repair or replacement approved by New Village. This warranty does not include refunds, incidental damages, consequential damages, loss of use, replacement of unrelated areas, or costs not approved in writing by New Village.

Manufacturer warranties, when applicable, are separate from New Village’s workmanship warranty. New Village does not guarantee manufacturer products beyond the warranty provided by the manufacturer. Labor to diagnose, remove, replace, reinstall, or service manufacturer-warrantied products may be charged unless otherwise stated in writing.

Retaining Walls

New Village Landscapes & Tree Services, LLC provides a limited 24-month workmanship warranty on new retaining wall installations.

This warranty covers defects directly caused by New Village’s workmanship, including major structural failure caused by improper installation, provided that the wall has not been altered, overloaded, damaged, or affected by site conditions outside of New Village’s control.

This warranty does not cover damage, movement, cracking, leaning, separation, settlement, washout, or failure caused by soil movement, settlement, expansion, contraction, poor existing soil conditions, water pressure, excessive water, drainage changes, erosion, flooding, failed existing drainage systems, tree roots, plant growth, nearby excavation, utility work, trench settlement, or additional loads placed above or near the wall after installation.

This warranty also does not cover damage caused by vehicles, equipment, sheds, pools, patios, structures, severe weather, freeze/thaw conditions, acts of God, natural ground movement, client modifications, third-party modifications, or walls built according to client direction against New Village’s recommendation.

Retaining walls are designed based on the visible site conditions and the scope of work included in the proposal. If engineering, permits, geogrid, drainage, excavation, soil stabilization, or additional structural components are not included in the written scope, they are not included in this warranty.

If the client believes a retaining wall has a covered workmanship defect, the client must notify New Village in writing within 30 days of discovering the issue and within the 24-month warranty period.

Fences

New Village Landscapes & Tree Services, LLC provides a limited 24-month workmanship warranty on new fence installations.

This warranty applies only to new fence installations completed by New Village. This warranty does not apply to fence repairs, add-ons to existing fences, partial replacements, or work performed on existing fence systems unless specifically stated in writing.

This warranty covers defects directly caused by New Village’s workmanship.

This warranty does not cover severe weather, wind, storms, fallen branches, soil contraction, settlement, movement, excessive irrigation, drainage issues, failure to keep vegetation away from the fence, damage from pets, animals, vehicles, equipment, misuse, gate issues caused by lack of maintenance or ground movement, natural aging, discoloration, or fading of materials.

Wood is a natural material and may warp, split, crack, shrink, twist, fade, or check over time. New Village does not warranty natural movement or deterioration of wood products.

Vinyl, aluminum, chain link, composite, or other manufactured materials may have a manufacturer warranty. Manufacturer warranties are separate from New Village’s workmanship warranty. If manufacturer warranty replacement materials are approved, the client may still be responsible for labor charges to remove and replace the material unless otherwise stated in writing.

If the client believes the fence has a covered workmanship defect, the client must notify New Village in writing within 30 days of discovering the issue and within the 24-month warranty period.

Decks

New Village Landscapes & Tree Services, LLC provides a limited 24-month workmanship warranty on new deck installations.

This warranty covers defects directly caused by New Village’s workmanship, including installation-related issues with framing, decking, railings, stairs, fasteners, or trim, provided the deck has been used and maintained properly.

This warranty does not cover movement, settlement, or shifting caused by soil conditions, damage caused by improper use, overloading, abuse, neglect, weather, storms, snow, ice, fallen branches, fire, flooding, acts of God, or natural movement of materials.

Wood is a natural material and may check, crack, split, twist, shrink, warp, fade, or discolor over time. These natural characteristics are not covered under warranty.

This warranty does not cover color variation, fading, staining, scratching, surface wear, mold, mildew, algae, dirt buildup, lack of cleaning, or damage caused by grills, fire pits, planters, furniture, rugs, chemicals, salt, snow melt products, client-supplied materials, third-party repairs, additions, or modifications.

Composite decking, PVC decking, railing systems, fasteners, lighting, and other manufactured products may have separate manufacturer warranties. New Village does not warranty manufacturer products beyond the manufacturer’s warranty. Labor to replace manufacturer-warrantied products may be charged unless otherwise stated in writing.

If the client believes the deck has a covered workmanship defect, the client must notify New Village in writing within 30 days of discovering the issue and within the 24-month warranty period.

Paver Patios, Walkways, Driveways & Hardscapes

New Village Landscapes & Tree Services, LLC provides a limited 24-month workmanship warranty on paver patios, walkways, driveways, steps, and hardscape installations.

This warranty covers defects directly caused by New Village’s workmanship, such as excessive settling or movement caused by improper installation.

This warranty does not cover minor settling, natural movement, efflorescence, color variation, fading, staining, surface wear, joint sand loss, weed growth, moss, algae, organic growth, damage from ants, burrowing animals, pests, roots, plant growth, drainage issues, erosion, flooding, freeze/thaw conditions, soil movement, deicing salts, chemicals, pressure washing, improper cleaning, or lack of maintenance.

This warranty also does not cover damage caused by heavy vehicles, equipment, dumpsters, trailers, or loads not intended for the area.

Pavers, wall block, caps, steps, and other manufactured hardscape products may have separate manufacturer warranties. Manufacturer warranties are separate from New Village’s workmanship warranty.

If the client believes there is a covered workmanship defect, the client must notify New Village in writing within 30 days of discovering the issue and within the 24-month warranty period.

Concrete Work

New Village Landscapes & Tree Services, LLC provides a limited 12-month workmanship warranty on concrete work installed by New Village.

This warranty covers major cracking wider than 1/2 inch or defects directly caused by New Village’s workmanship.

Concrete is a natural material and is subject to curing, shrinkage, cracking, color variation, surface variation, and weather-related changes. New Village does not warranty the concrete batch, concrete mix, or supplier-provided materials. Any warranty related to the concrete mix itself must be handled through the concrete supplier.

This warranty does not cover hairline cracks, shrinkage cracks, cracks along or within control joints, surface scaling, spalling, flaking, pop-outs, discoloration, color variation, stamped concrete color variation, finish variation caused by weather or site conditions, damage from deicing salts, chemicals, snow melt products, improper cleaning, heavy vehicles, equipment, commercial use, misuse, fire, flood, freeze/thaw conditions, tree roots, plant growth, soil movement, settlement, drainage issues, defective subsurface conditions, or utility trench settlement.

Color uniformity is not guaranteed. Concrete color may vary within the same pour, between separate pours, and between original and repaired or replaced areas.

If the client believes a covered concrete defect has occurred, the client must notify New Village in writing within 30 days of discovering the issue and within the 12-month warranty period.

Drainage Work

New Village Landscapes & Tree Services, LLC provides a limited 12-month workmanship warranty on drainage systems installed by New Village.

Drainage work is designed to improve water flow based on visible site conditions at the time of installation. New Village does not guarantee that drainage work will eliminate all water, standing water, groundwater, saturation, erosion, flooding, or future drainage issues.

This warranty covers defects directly caused by New Village’s workmanship.

This warranty does not cover extreme rainfall, storms, flooding, acts of God, changes in grading, landscaping, patios, structures, pools, gutters, downspouts, neighboring properties, clogged pipes, clogged drains, clogged basins, clogged outlets, clogged pop-ups, leaves, debris, roots, mud, animals, lack of maintenance, groundwater, high water table, springs, underground water sources, erosion, washout, vehicles, equipment, digging, landscaping, or third-party work.

The client is responsible for keeping drain inlets, basins, grates, outlets, pop-ups, and drainage areas clear of debris.

If the client believes there is a covered workmanship defect, the client must notify New Village in writing within 30 days of discovering the issue and within the 12-month warranty period.

Grading, Excavation & Soil Work

New Village Landscapes & Tree Services, LLC provides a limited 30-day workmanship warranty on grading and excavation work.

Grading, excavation, and soil work may change after completion due to weather, erosion, settlement, soil conditions, drainage, foot traffic, equipment, landscaping, or future work performed on the property.

This warranty covers only defects directly caused by New Village’s workmanship.

This warranty does not cover natural settlement, soil compaction, erosion, washout from rain or storms, movement caused by drainage, groundwater, poor soil conditions, vehicles, equipment, pets, people, third-party work, client use, landscaping, construction, utility work, irrigation, or soil conditions not visible at the time of work.

If the client believes there is a covered issue, the client must notify New Village in writing within 30 days of completion.

Plumbing Work

New Village Landscapes & Tree Services, LLC provides a limited 12-month workmanship warranty on plumbing work performed by New Village or by a plumbing subcontractor arranged through New Village.

This warranty covers defects directly caused by workmanship during installation.

This warranty does not cover existing plumbing systems, pre-existing conditions, clogged drains, blockages, backups, debris in existing lines, frozen pipes, freeze damage, misuse, neglect, improper maintenance, improper operation, water pressure issues, hard water, mineral buildup, corrosion, deteriorated existing pipes, client-supplied fixtures, client-supplied materials, third-party work, third-party modifications, movement, settlement, freezing, or external damage.

Fixtures, valves, pumps, heaters, and equipment may be covered by a separate manufacturer warranty. Manufacturer warranties are separate from New Village’s workmanship warranty. Labor to diagnose, remove, replace, or reinstall manufacturer-warrantied items may be charged unless otherwise stated in writing.

If the client believes there is a covered plumbing workmanship defect, the client must notify New Village in writing within 30 days of discovering the issue and within the 12-month warranty period.

For emergency plumbing issues, the client should take reasonable steps to prevent additional damage, including shutting off the water supply if necessary.

Electrical Work

New Village Landscapes & Tree Services, LLC provides a limited 12-month workmanship warranty on electrical work performed by New Village or by an electrical subcontractor arranged through New Village.

This warranty covers defects directly caused by workmanship during installation.

This warranty does not cover existing electrical systems, pre-existing conditions, overloaded circuits, tripped breakers caused by client use or connected devices, power surges, lightning, storms, water intrusion, pests, acts of God, light bulbs, lamps, batteries, transformers, timers, remotes, smart devices, accessories, client-supplied fixtures, client-supplied materials, third-party repairs, modifications, or additions.

Low-voltage lighting damage from landscaping, animals, wire cuts, mulch work, digging, improper use, or lack of maintenance is not covered.

Fixtures, devices, panels, breakers, outlets, switches, lights, pumps, automation systems, transformers, and other electrical products may be covered by separate manufacturer warranties. Manufacturer warranties are separate from New Village’s workmanship warranty. Labor to diagnose, remove, replace, or reinstall manufacturer-warrantied items may be charged unless otherwise stated in writing.

If the client believes there is a covered electrical workmanship defect, the client must notify New Village in writing within 30 days of discovering the issue and within the 12-month warranty period.

Pools

New Village Landscapes & Tree Services, LLC provides a limited 12-month workmanship warranty on pool installation labor performed by New Village.

This warranty covers defects directly caused by New Village’s workmanship during installation.

This warranty does not cover pool kits, liners, pumps, filters, heaters, salt systems, automation systems, lights, covers, ladders, rails, skimmers, returns, or other manufacturer products beyond the manufacturer warranty.

This warranty does not cover damage caused by improper chemical balance, improper maintenance, freezing, winterization issues, low water level, misuse, pets, sharp objects, storms, flooding, groundwater, soil movement, settlement, acts of God, third-party service, pool companies, electricians, plumbers, or homeowner modifications.

Liner wrinkles, fading, discoloration, staining, bleaching, punctures, tears, and chemical damage are not covered.

Manufacturer warranties for pool kits, equipment, liners, lights, heaters, pumps, filters, salt systems, automation systems, and accessories are separate from New Village’s workmanship warranty. Labor to diagnose, remove, replace, or reinstall manufacturer-warrantied items may be charged unless otherwise stated in writing.

If the client believes there is a covered workmanship defect, the client must notify New Village in writing within 30 days of discovering the issue and within the 12-month warranty period.

Roofing, Additions, Remodeling & General Construction

New Village Landscapes & Tree Services, LLC provides a limited 12-month workmanship warranty on roofing, additions, remodeling, framing, trim, siding, doors, windows, and general construction work unless a different warranty period is stated in writing.

This warranty covers defects directly caused by New Village’s workmanship.

This warranty does not cover existing structural issues, pre-existing conditions, water intrusion caused by existing roofing, siding, windows, doors, flashing, grading, drainage, gutters, or other systems not included in New Village’s scope.

This warranty also does not cover movement, cracking, nail pops, caulk separation, or settlement caused by normal expansion, contraction, or building movement.

Windows, doors, roofing materials, siding, fixtures, hardware, appliances, and other manufactured products may have separate manufacturer warranties. Manufacturer warranties are separate from New Village’s workmanship warranty. Labor to replace manufacturer-warrantied products may be charged unless otherwise stated in writing.

If the client believes there is a covered workmanship defect, the client must notify New Village in writing within 30 days of discovering the issue and within the 12-month warranty period.

Plants

New Village Landscapes & Tree Services, LLC provides a limited 6-month warranty on plants purchased and installed by New Village.

This warranty does not apply to existing plants, transplanted plants, client-supplied plants, annuals, perennials, sod, seed, or plants damaged by lack of watering, overwatering, improper care, pests, disease, animals, weather, drainage issues, soil conditions, irrigation issues, or acts of God.

The client is responsible for proper watering, maintenance, and care after installation.

If the client believes a plant requires warranty service, the client must notify New Village in writing within the 6-month warranty period. New Village will inspect the plant and determine whether treatment, replacement, or no corrective action is appropriate.

If replacement is approved, New Village will cover 50% of the cost of the replacement plant and installation labor. New Village will determine the replacement size, variety, timing, and method of installation based on availability and site conditions.

Sod

Newly installed sod is living material and requires immediate and consistent watering and maintenance by the client. Because sod success depends on watering, weather, sunlight, soil conditions, drainage, irrigation coverage, foot traffic, pets, and ongoing care, New Village does not provide a guaranteed establishment warranty for sod.

If the client notices spotty, patchy, dry, or failing areas, the client must notify New Village in writing within 48 hours of noticing the concern. New Village will review the condition and may, at its discretion, recommend additional watering, treatment, repair, or replacement.

Any repair or replacement is determined on a case-by-case basis and is not guaranteed unless approved in writing by New Village.

Seed

Grass seed is not covered by a guaranteed establishment warranty. Seed germination and growth depend on proper watering, weather, soil temperature, soil conditions, drainage, erosion, sunlight, foot traffic, pests, birds, and client maintenance.

The client is responsible for keeping the seeded area consistently moist and protected during the germination period.

If the client experiences germination concerns, the client must notify New Village in writing within 48 hours of noticing the issue. New Village will review the area and may recommend additional watering, reseeding, straw, erosion control, or other corrective action.

Any reseeding or repair will be determined on a case-by-case basis and is not guaranteed unless approved in writing by New Village.

Warranty Claim Procedure

To submit a warranty claim, the client must email [email protected] with the following information:

  • Client name
  • Project address
  • Date work was completed
  • Description of the concern
  • Photos or videos of the issue
  • Date the issue was first noticed

New Village will review the request and schedule an inspection if necessary. New Village must be given the opportunity to inspect the concern before any repair, replacement, removal, modification, or third-party work is performed.

Warranty determinations and remedies are made by New Village according to the terms of this limited warranty.
